1. Agreement

By using Navain AI's services, you agree to these Terms of Service. If you do not agree, do not use our service. "Service" means the Navain AI voice agent platform, website, and related products operated by us.

2. The service

Navain AI provides an AI-powered voice receptionist that answers inbound calls on behalf of your business, collects caller information, and books appointments into your calendar. The service operates via call forwarding to a Navain AI number — no hardware installation is required.

3. Your account

You are responsible for maintaining the security of your account credentials. You must provide accurate information when signing up. You may not share your account with third parties or use the service on behalf of a business you do not own or have authority to represent.

4. Acceptable use

You agree not to use Navain AI to:

• Conduct illegal activity or fraud
• Deceive callers in ways that could cause harm
• Violate any applicable call recording or consent laws in your jurisdiction
• Resell or sublicense the service without written permission
• Attempt to reverse-engineer, copy, or disrupt our systems

You are responsible for ensuring your use of call recordings complies with the laws in your state or country (e.g. two-party consent states in the US).

5. Payment and billing

Subscription fees are billed monthly in advance. Setup fees are one-time and non-refundable once setup has commenced. If payment fails, we may suspend your service after reasonable notice. All prices are in USD unless otherwise stated.

6. Cancellation

You may cancel your subscription at any time by contacting us. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for unused days.

7. Service availability

We aim to provide a reliable, high-uptime service but do not guarantee 100% availability. Planned maintenance will be communicated in advance where possible. We are not liable for losses caused by service interruptions outside our reasonable control.

8. Call recordings and data

You retain ownership of call recordings and transcripts from your business's calls. By using the service, you grant us a limited licence to process this data in order to operate and improve the service. See our Privacy Policy for full details.

9. Limitation of liability

To the maximum extent permitted by law, Navain AI's total liability to you for any claim arising from the service shall not exceed the fees you paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify and hold Navain AI harmless from any claims, damages, or costs (including legal fees) arising from your use of the service in violation of these Terms or applicable law.

11. Intellectual property

All technology, branding, and content that makes up the Navain AI platform is owned by us. You may not copy, reproduce, or create derivative works from our platform without written consent.

12. Modifications

We may update these Terms at any time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the new Terms.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
